Summary

As Introduced. Health carriers; use of artificial intelligence; disclosures; right to expedited external review; civil penalties.

Requires health carriers to disclose how artificial intelligence is used to manage claims coverage and to submit all information enabling decisions made by artificial intelligence to the State Corporation Commission upon request. The bill prohibits health carriers from relying exclusively on artificial intelligence to make any adverse determination and requires health carriers to provide an expedited external review process for appealing any such determination. The bill provides a private right of action for any covered person to enforce the provisions of the bill. Finally, the bill authorizes civil and administrative penalties for violations including civil penalties of up to $50,000, revocation or suspension of a health carrier's license, and compensation to an affected covered person and health care providers.
